Release and Waiver of Liability Agreement

 

This Release and Waiver of Liability Agreement ("Agreement") is entered into as of 02/14/2024 by and between Action Shots, Inc. ("Company"), located at 3522 Kirby Ln, and ____________________________ ("Client"). Client is the parent or legal guardian of ____________________________ ("Minor"), who is also a party to this Agreement.

 

1. Acknowledgment of Risks: 

Client acknowledges that the photo shoot involves certain risks, including but not limited to the risk of injury or harm caused by fire, smoke, or other elements used in the photo shoot. Client understands that these risks may result in personal injury, illness, permanent disability, or death, and voluntarily assumes all such risks for themselves and Minor.

 

2. Release of Liability: 

Client, on behalf of themselves and Minor, hereby releases, waives, discharges, and covenants not to sue Company, its officers, employees, agents, and representatives, as well as Companies Insurance Providers, from any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, injury, or death that may be sustained by Client or Minor, or any property belonging to them, while participating in the photo shoot or while on the premises where the photo shoot is conducted.

 

3. Indemnification: 

Client agrees to indemnify and hold harmless Company, its officers, employees, agents, and representatives, as well as Company and Owner’s Insurance Providers, from any and all claims, demands, losses, damages, and liabilities, including reasonable attorneys' fees, arising from or related to Client's or Minor's participation in the photo shoot or any breach of this Agreement by Client or Minor.

 

4. Governing Law: 

This Agreement shall be governed by and construed in accordance with the laws of the State of Kentucky.

 

5. Entire Agreement: 

This Agreement contains the entire agreement between the parties and supersedes any prior or contemporaneous agreements, representations, or understandings, whether written or oral.

 

6. Severability: 

If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

7. Binding Effect: 

This Agreement shall be binding upon and inure to the benefit of the parties and their respective heirs, executors, administrators, legal representatives, successors, and assigns.

 

8. 8. Acknowledgment: 

Client acknowledges that they have read this Agreement, understand its terms, and are signing it voluntarily. Client further acknowledges that they have had the opportunity to seek independent legal advice prior to signing this Agreement.

 

IN WITNESS WHEREOF, the parties have executed this Release and Waiver of Liability Agreement as of the date first above written.
